Gateway Casinos & Entertainment is among the leaders in the Canadian casino field, as it oversees the operation of many gaming halls across the country. Earlier this summer, Chances Casino Kamloops’ Director of Marketing saw his contract terminated sooner than expected when the venue saw a management change. Now Bryce Herman has launched a legal battle against Gateway Casinos for CA$135,000.
The acquisition makes Gateway the sole gaming provider in Kamloops, as the operator of both Cascades Casino Kamloops and Chances Kamloops. This strategic acquisition marks the latest step in Gateway’s growth strategy which has seen the company expand their footprint and product offering across Canada with their proprietary casino. Management change at a given location could lead to unexpected changes directly affecting the employees. At the end of the day, this might not be an ideal situation, but it aligns with the unique way in which the new management conducts business. It also sets the tone for future operation, eyeing better performance down the road. The beginning of this year saw Gateway Casinos acquire Chances Casino Kamloops and add it to its extensive portfolio. This made the casino operator the sole gaming provider in the area.
Bryce Herman’s Employment Agreement Was Terminated
Up until that point, the casino giant had overseen Cascades Casino Kamloops, a rival gaming property that diversified the field and resulted in healthy competition between the two locations ever since 2015. The change of management at Chances Casino Kamloops spelled the end for Mr. Herman’s extensive career on site of the casino venue.
He had been associated with the casino staff ever since 2002 and his contributions to the premium facility have been unrivaled. In his position of Director of Marketing for Chances Casino, many organized events have come to fruition with stellar results. Such has been the case until July 31, when he saw the end of his career at the casino location.
Mr. Herman claims that his contract was terminated sooner than it was supposed to, eventually violating its conditions. His notice of civil claim was filed in the local registry of the British Columbia Supreme Court and in it, Mr. Herman makes is clear that he considers his rights violated. The new casino management also failed to produce a “reasonable notice of severance in lieu of reasonable notice” of dismissal.
Casino Dismisses All Claims
Prior to his last day at the casino venue, Mr. Herman saw rumors spread around Kamloops about the upcoming end of his employment at Chances Casino. Supposedly, the new general manager Robert Case did all of this. This spring saw Mr. Herman overhear a conversation about his firing, which came as a surprise to him and caused him distress.
The employment agreement Mr. Herman had prior to the firing was a verbal one with the previous owners of the casino venue – Pat and Gary Hart. At the very beginning of his career, he bagged a monthly wager of CA$3,000, ultimately swelling to CA$4,500. It was supposed to come to an end July 31, but instead, it was terminated June 20.
Damages he seeks, reach CA$135,000, but the casino venue stated that Mr. Herman was an independent contractor and the arrangement was not an exclusive one. Moreover, allegedly the previous management never referred to him as an employee in front of Gateway Casinos, but instead as a contractor. The casino also pointed out that earlier this year, Mr. Herman was offered the position of Guest Services Manager, which he declined.
